You’re thinking about buying a new home! You drive by a home that looks like a good possibility for your family. Are you like most people……and call the number on the sign? But always be careful when you are working with real estate agents. Know the difference!
Which lawyer would you choose? If someone filed a lawsuit against you, would you go to their attorney and ask him or her to represent you? Probably not! Your best interests would be served by hiring your own attorney. It’s much the same with home buying. It’s the single largest investment most of us will ever make. Our goal is to make sure you have purchased this home for the best possible terms and price.
But somehow, we have been trained to call the phone number on a real estate sign when we want to purchase the home. Without stopping to think that the listed agent has a legal contract with that seller to obtain the best possible price and terms for the property. When you call that agent, you are putting yourself in the position of not having any representation at all.
State law requires a stated level of representation for every agency relationship. I’ve listed the difference between Traditional Agents that have been designated by their broker to represent a buyer……..and Buyer’s Agents (Advocates) that give buyers 100% of their attention and loyalty. ….going far and above what is expected. It pays to be educated when working with Nashville real estate agents.

An interesting decision from the Oklahoma Supreme Court
In the case of Snyder v. Oklahoma Real Estate Commission in June of 1999……the Oklahoma Supreme Court said……. “Sellers’ agents and dual agents do not and cannot by law give the buyer the same degree of loyalty as an agent who acts on behalf of the buyer. Sellers’ agents owe their allegiance to the seller. Dual agency invites a conflict of interest. A buyer who relies on the seller’s agent or on dual agency does not receive the same degree of legal protection as that afforded by an agent acting solely on behalf of the buyer.”
